How Do I Apply For Supreme Court Bail?
A Supreme Court bail application takes longer and is more formal than a Local Court bail application. If your bail application is refused in the Local Court you have recourse to the Supreme Court.
It begins in the same fashion as a Local Court with a bail application being lodged with the Court Registry and served upon the Prosecution. Anybody putting up a surety should be served with the relevant material as well.
The upside of a Supreme Court bail application is that the presiding Judge will hear the matter afresh.
To have the matter listed, we will lodge:
- Supreme Court bail form
- Written submissions and proposed bail conditions (arguments and conditions if released on bail for the accused person)
- All supporting evidence, including affidavit, reports, character reference letters
- Consent letter from surety who is willing to put up a bail bond or security as a bail condition.
The Supreme Court will first list the bail application for a first date called a call over. If the bail application is compliant, a hearing date will be set.
If Supreme Court Judge is satisfied at hearing that with both tests- show cause test and unacceptable risk test – are satisfied, you will regain your liberty.
